International Court of India (ICJ) will hear the case of Indian citizen Kulbhushan Jadhav on May 15. The ICJ had banned the death sentence given by Pakistan's military court on Tuesday. Significantly, Jadhav was heard hanging in Pakistan last month.
According to the experts, India had no other legal option than leaving the ICJ in Kulbhushan case. At the same time, it is believed that India has achieved diplomatic success in Pakistan by preventing ICJ from the punishment of Kulbhushan Jadhav's death sentence.
All efforts to ban Kulbhushan Jadhav's execution in Pakistan had failed. India feared that Pakistan could offer Jadhav without hanging there without any legal help. Pakistani judicial process experts believe that even if India reached Pakistan's Supreme Court against the military court's decision, Jadhav had little chance of getting justice from there.
The Pak army is already trying to make the judicial process biased against Jadhav already. Although India has called for a ban on the death penalty in the International Court while citing violation of the Vienna Treaty linked to diplomatic relations.
46 years later ICG reached India
India has reached international court in relation to any case after 46 years. India has surprised Pakistan by its move. This is the second opportunity since 1947 when India has chosen this option.
